Judicial Review & Public Law.

Administrative law, constitutional petitions and judicial review of the decisions of public authorities, before the High Court.

High CourtCourt of Appeal
01What this covers
Public power is reviewable. The Constitution says so.

When a public body decides something unlawfully, unfairly or without hearing those affected, the High Court can intervene. The firm brings and defends judicial review applications and constitutional petitions, and advises public and private clients on administrative-law exposure before a decision is challenged.

  • Judicial review: certiorari, mandamus and prohibition against public bodies
  • Constitutional petitions, including enforcement of the Bill of Rights
  • Challenges to licensing, procurement and disciplinary decisions
  • Fair administrative action: the right to be heard and to be given reasons
  • Public-interest litigation
  • Advice to decision-makers on acting lawfully
02How the firm works

From instruction to result.

01

Instruction & assessment

Time limits in judicial review are short and strict. We first establish the decision, its date and the route of challenge, and say immediately if leave must be sought at once.

02

Application & petition

The application for leave, the substantive motion or the petition, with the record of the decision and the supporting affidavits.

03

Hearing & orders

Argued before the High Court, with the orders sought framed so that they can be complied with, and enforced if they are not.
